Obama Admin Wins a Healthcare Victory
The court battle over President Obama's healthcare reform program has swayed a bit in favor of the Obama plan.
On June 29 the 6th U.S. Circuit Court of Appealsin Cincinnati upheld the sweeping healthcare reform law that requires U.S. residents to purchase health insurance. Opponents of the healthcare law have argued the requirement to force Americans to buy healthcare insurance is unconstitutional. There have been some court decisions that have ruled the healthcare program is unconsitutional, based on the argument that the federal government cannot force citizens to buy health insurance.
In the latest ruling from Cincinnati, the appeals court noted that the “minimum coverage provision is a valid exercise of legislative power by Congress under the Commerce Clause” of the U.S. Constitution.
You can bet the battle is far from over. It is widely believed the final ruling on the constitutional argument will take place at the U.S. Supreme Court.
